Case I — The Christmas Armistice

Year: 2023
Status: Judicial Precedent
Subject: Alternative-day attendance and temporary constitutional suspension

Matter Before the Court

The High Pastry Court was asked to determine whether the ordinary restrictions governing attendance at Greggs outside the Club’s Friday meeting could be suspended during the Christmas period.

The Court considered whether the exceptional circumstances of the Christmas period justified a temporary departure from the ordinary Friday attendance requirements.

Constitutional Provisions Considered

  • Article I — The Friday Principle
  • Article III — Alternative-Day Attendance
  • Article IX — Exemptions & Pardons

Judgment

The High Pastry Court determined that the Christmas period constituted exceptional circumstances warranting the temporary suspension of the ordinary restrictions governing alternative-day attendance.

The Court therefore declared a Christmas Armistice, during which Members were permitted to visit Greggs outside the ordinary Friday meeting without incurring the usual alternative-day penalty.

The Armistice was originally intended to remain in force for the Christmas period and was subsequently extended beyond its original expiry date until 8 January 2024.

Order / Verdict

ARMISTICE GRANTED.

The ordinary alternative-day attendance restrictions were suspended for the duration of the Christmas Armistice.

Penalty / Remedy

None.

The purpose of the ruling was to provide a temporary exemption from the ordinary attendance restriction.

Precedent

Yes — Judicial Precedent

This case establishes the principle that the High Pastry Court may temporarily suspend an ordinary constitutional restriction where exceptional circumstances justify such action.

Such a suspension is:

  • temporary in nature;
  • limited to the circumstances identified by the Court;
  • subject to any conditions imposed by the Court; and
  • not, by itself, a permanent amendment to the Constitution.

A Christmas Armistice therefore does not create a general entitlement for Members to disregard the ordinary Friday attendance requirements during future Christmas periods. Any future suspension must be separately authorised by the High Pastry Court or otherwise provided for by the Constitution.
